Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Indigo Milestones, including our website at indigo-milestones.com and any associated applications and services (collectively, the “Service”), operated by Indigo Milestones (“Indigo Milestones,” “we,” “our,” or “us”). Please read these Terms carefully. By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old to use the Service (or at least 16 if you reside in the European Economic Area or the United Kingdom). By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

2. Account Registration and Security

To use most features, you’ll need to create an account by signing in with a supported authentication provider. You’re responsible for:

• Maintaining the confidentiality of your sign-in credentials
• All activity that occurs under your account
• Notifying us promptly if you suspect unauthorized access

You agree to provide accurate, current, and complete information and to keep it up to date.

3. Your Content

You retain full ownership of the paths, milestones, steps, comments, attachments, and other content you create or upload to the Service (“Your Content”). By using the Service, you grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, process, transmit, display, and back up Your Content solely to operate, secure, and improve the Service.

If you mark content as public (e.g., a public path or profile), you grant us and other users a license to display that content publicly through the Service for as long as it remains marked public.

You are responsible for Your Content and for ensuring you have the rights to upload and share it.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Upload content that infringes intellectual-property rights, defames others, or is otherwise illegal
• Attempt to gain unauthorized access to other accounts, systems, or networks
• Interfere with or disrupt the Service, including through denial-of-service attacks, malware, or excessive automated requests
• Scrape, harvest, or otherwise collect data from the Service in bulk without our written permission
• Reverse-engineer, decompile, or attempt to extract the source code of the Service, except as permitted by law
• Misrepresent your identity or your affiliation with any person or entity
• Resell, sublicense, or commercially exploit the Service without our written permission

We may suspend or terminate accounts that violate these rules.

5. Intellectual Property

The Service, including its design, branding, and software, is owned by Indigo Milestones and protected by intellectual-property laws. Except for the rights expressly granted in these Terms, we reserve all rights in the Service.

6. Subscriptions, Billing, and Refunds

The Service is currently offered free of charge during our pre-launch period. Paid subscriptions (Starter and Pro) are planned. When billing becomes available:

• Subscription fees are charged in advance for the chosen billing period
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period
• Refund eligibility and procedures will be described at the time of purchase

Full billing terms will be published before billing is enabled. Pre-launch use does not entitle you to free access after launch beyond what’s offered in the Free tier.

7. Beta Service & “As-Is”

The Service is in active development. Features may change, be removed, or be limited without notice. We make no guarantee that the Service will be uninterrupted, error-free, or that any specific data, feature, or output will be preserved over time. To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied.

8. Modifications to the Service

We may modify, suspend, or discontinue any part of the Service at any time. When feasible, we’ll give reasonable advance notice for material changes, and we’ll provide a way to export your data before discontinuing the Service.

9. Termination

You may delete your account at any time from your account settings or by contacting us. We may suspend or terminate your access if you violate these Terms or if continued provision of the Service to you would expose us to legal liability. On termination, your right to use the Service ends, and we will delete your account data subject to the retention practices described in our Privacy Policy.

10. Disclaimers

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade. We don’t warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.

11. Limitation of Liability

To the fullest extent permitted by law, Indigo Milestones and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our aggregate liability for any claim arising out of these Terms or the Service will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) USD 100.

Some jurisdictions don’t allow certain limitations of liability, so portions of this section may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Indigo Milestones and its operators from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from Your Content or your violation of these Terms or any applicable law.

13. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which Indigo Milestones is operated, without regard to its conflict-of-laws principles. We’ll work in good faith to resolve any dispute informally before formal proceedings begin. Unless otherwise required by applicable consumer-protection law, disputes will be resolved in the courts of that jurisdiction.

14. Changes to These Terms

We may revise these Terms from time to time. When we do, we’ll update the “Last updated” date and, for material changes, notify you by email or through the Service before the change takes effect. Your continued use of the Service after a change indicates your acceptance of the revised Terms.

15. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce a provision is not a waiver of our right to do so later. These Terms constitute the entire agreement between you and Indigo Milestones regarding the Service.
